Introduction

At Gunseeker we are committed to providing the largest choice of guns, accessories and clothing available anywhere on-line. Gunseeker is the most advanced website of its kind with the largest advertising budget, the most RFD dealers listed and a complete network of experts providing the backup and continuous improvement you would expect.

Our task is to facilitate the sale of items on the site, however we are by no means responsible for the sale, this is between the seller and the buyer, and as such Gunseeker will not enter into any disputes between the two.

We advise that you read our terms and conditions carefully, At Gunseeker we have spent considerable time ensuring that our terms are fair to both yourselves and us (Gunseeker Ltd).

We reserve the right to change our terms and conditions at any time.

General

If you are more than one legal entity, each person or legal entity accepts joint liability under these terms.

Reference to something in the masculine form includes the feminine and neuter forms and vice versa and reference to the singular includes the plural and vice versa.

These terms are to be interpreted in accordance with English Law and any disputes regarding these terms will be subject to the jurisdiction of English courts of law.

Listings and Advertising

• Public
   
  • All listings will be paid for on-line using the secure Worldpay payment portal
  • Gunseeker reserve the right to refuse listings and/or advertisements
  • Listings and Advertising will run for a period of a month at a time, to extend advertisement subsequent payment is required
     
• Trade
   
  • Trade pay a yearly listing fee, payable on-line using the secure World Pay payment portal, Bacs or by cheque.
  • Depending on the price paid this entitles the trade member to advertise all of their guns on a monthly basis.
  • Site advertisements run for a 6 month schedule, this is payable at the time of placing the advertisement.
  • Depending on availability the advert can be tailored to appear on the most relevant result pages.
     
• Our Rights
   
  • We maintain the right to refuse/remove listings and/or advertisements, should these be in breach of our terms and conditions, are deemed to be not appropriate for the gunseeker website or abuse our users.
     

Service availability

Gunseeker is professionally hosted using the latest technologies available, we agree to always ensure that we endeavour to ensure that the site is kept running and does not experience any downtime. However as you are aware it is technically impossible for us to guarantee that the site does not have any downtime, and as such should we experience any we will endeavour to ensure the site is back up and running ASAP.

From time to time Gunseeker will require routine maintenance, we will ensure that this is carried out during off-peak times.

Payment terms

All listings / advertisements are payable when the listing / advertisement is ordered.

Your warranties regarding listing content

You warrant to us that all copy is accurate, up-to-date and not misleading in any way and that it complies with the standards set by the Advertising Standards Authority and that no content will breach any third party intellectual property rights or be illegal, immoral, offensive or defamatory. In particular, you warrant that any pictures and text are your own copyright and you grant us an irrevocable, perpetual, exclusive, worldwide, royalty-free licence to use such images and text.

You also warrant that all material you upload to our website is free of any virus, worm, Trojan horse or similar thing and will not materially adversely affect the normal operation of any software or hardware of ours or of any visitor to our Website.

Your warranty regarding right to sell & compliance with laws

You warrant that you will not offer anything for sale which is not or will not on sale be yours to sell and free from any lien or other liability ? in other words, you warrant that the item being sold belongs to you and is not subject to rights in favour of anyone else.

You warrant that you comply in all respects with UK firearms laws and other laws governing the sale and keeping of items listed by you. In particular, you warrant that you are of an age that is entitled to make the listing under such laws and that in any event you are aged 18 or over.

Username and Password Use

You will be allocated your own unique username and password and you agree to keep your username and password confidential and not to pass it on to any third party for any reason whatsoever.

You agree to notify us immediately that you become aware that someone may have unauthorised access to your account.

Privacy

You understand that by displaying the name or email address of a contact in your listing, you are providing personal data to us. As such, you warrant that you have the consent of the person whose name you have given to appear in the listing in compliance with the Data Protection Act 1998
